I think that for most places in the US driving on the pavement/sidewalk
would be a moving violation under state law, which would not only result
in a fine but potentially affect a driver's license and insurance cost.
Parking on it would be a violation of local law and would only result in
a fine. Something similar is done (at least in this area) for running a
red light. If the violation is observed by an officer then it's written
as a moving violation. If the violation is observed by a camera it's
treated the same as a parking violation.
