What if the victim calls his bluff, as the victim believes that the
baddie would rather both of them lived than both of them died.

The reason it doesn't work in car-bike or car-pedestrian situations is
because the law doesn't treat someone who kills with a car anything
like it treats someone who kills with a gun.

A rational justice system would treat someone who drives without
watching where they're going, and a result kills someone, the same
as it treats someone who fires a gun randomly out a window without
looking, and a result kills someone.
