Assuming that Carter is still in the military, the planet is under the 
uniform military code (think that is what it is called) .  Carter is in 
command and can do whatever she wants to.  She may have to answer later to

Stargate Command or some such.  It does not mater if it is legal or not,
she 
controls the men that have all the guns on the planet, or atleast enough
of 
the guns that no body has been able to over throw the Earth team.  Unless 
they quit backing her, she is in command and everyone on the planet does 
what she wants them to.

Now if Teyla doesn't think Carter can keep her from leaving, all she has
to 
do is give Stargate command a call and see what they say. As if this would

hapen.

There are many examples that laws do not always apply, just ask the 
Japaneese that are (were) American citizens in the United states during WW

2.  New laws can always be passed as needed.

Ask the Indians what kind of laws were violated in this country.
I don't keep up with current events all that much, but ask the prisoners 
from Arab land that are being held in , what is it, maybe Cuba by the US. 
Why are they being held and what are the charges and where is their trial
?
